CONDIZIONI DI VENDITA
Note
This is a translation. The French version of these terms prevails.
1. Seller
Enamya — [email protected]
VAT not applicable, article 293 B of the French General Tax Code.
2. Scope
These terms govern the distance sale, on enamya.fr, of licences to use beats (instrumentals) and licences for audio plugins (VST3, AU), delivered by download. They apply to every order; the customer accepts them by ticking the box provided before payment.
3. Products
Beats: the customer does not buy the work but a non-exclusive licence to use it, whose scope (format, number of streams, uses) is described on the licences page and in the licence PDF delivered with the files. Enamya remains the copyright holder. Exclusive licences cannot be bought online: they are subject to a separate quote and written agreement, on request through the contact page.
Plugins: the customer buys a personal, non-transferable licence to use the software. System requirements (OS, formats) are listed on each plugin page; the customer must check them before buying.
4. Prices
Prices are in euros, all taxes included. VAT not applicable, article 293 B of the French General Tax Code. The applicable price is the one displayed when the order is placed.
5. Order and payment
The customer adds items to the cart, then confirms the order on Stripe’s secure payment page, entering an e-mail address and payment details. The seller never has access to card data. The contract is concluded once payment is confirmed; a receipt is sent by e-mail.
6. Delivery
Files are available immediately after payment, on a download page whose link is also sent by e-mail. Download links are valid for 24 hours and the page remains available for 30 days after purchase. In case of difficulty, the customer contacts the seller, who sends the files again.
7. Right of withdrawal
Under article L221-28, 13° of the French Consumer Code, the right of withdrawal cannot be exercised for digital content not supplied on a tangible medium where performance has begun with the consumer’s prior express consent and express waiver of the right of withdrawal.
Before paying, the customer expressly requests immediate access to the files and acknowledges losing the right of withdrawal. This consent is confirmed by e-mail.
8. Legal guarantees
The customer benefits from the legal guarantee of conformity for digital content and services (articles L224-25-12 et seq. of the French Consumer Code). If the content does not conform (corrupt or incomplete file, plugin not working on a configuration stated as compatible), the customer contacts the seller, who brings the content into conformity or, failing that, issues a refund.
9. Liability
The seller is not liable for any use of the beats not covered by the licence purchased, nor for damage resulting from installation on an unsupported configuration.
10. Personal data
See the privacy policy.
11. Mediation and disputes
In case of dispute, the customer first contacts the seller at [email protected]. Failing agreement, the customer may refer the matter free of charge to the consumer mediator.
These terms are governed by French law. Consumers keep the protection of the mandatory provisions of the law of their country of residence.
